1. Acceptance of Terms

1.1 Your Agreement with Us

By accessing or using the Trackeno Studio website (trackeno.space) or any of our games, you ("the Player" or "the User") agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our services. This is a legal contract between you and Trackeno Studio, a company registered in Italy (Via Roma 123, 00100 Roma).

Age Requirement

Our games are designed for a general audience. Some titles may have specific age ratings or content warnings. You must be at least 13 years old, or the age of digital consent in your jurisdiction, to create an account. For users under 18, parental consent is required.

Account Responsibility

You are responsible for safeguarding your password and for all activities under your account. Notify us immediately of any unauthorized use. We are not liable for losses due to your failure to secure your account.

Data You Provide

Any content you upload, post, or transmit through our services (e.g., in-game chat, forum posts) remains your property, but you grant Trackeno Studio a non-exclusive, royalty-free license to display, modify, and distribute it for operational purposes.

Prohibited Conduct

Our community is built on respect. We maintain a zero-tolerance policy for:

  • • Harassment, hate speech, or discriminatory behavior
  • • Cheating, exploiting bugs, or using unauthorized third-party software
  • • Infringing on the intellectual property of others
  • • Commercializing your account or in-game assets without express permission

1.3 Intellectual Property & User-Generated Content

Our IP Trackeno Studio owns all rights, title, and interest in our games, the website, logos, artwork, code, and original content. Our games are protected by copyright, trademark, and other international laws.

IP Asset Representation

User Content You retain ownership of your creations (mods, fan art, videos). By sharing them, you grant us a license to feature them. We reserve the right to remove content that violates these terms or our community guidelines.

User Creating Content

Open Source Trackeno Studio may release certain code snippets or tools under open-source licenses. These are separate projects with their own licenses and are not covered by this ToS.

Common Pitfalls & How to Avoid Them

The "Free-for-All" Assumption

Thinking all mods and fan content are automatically allowed. Fix: Always check the specific game's modding policy and respect trademarks. Don't use our IP in commercial projects without permission.

Ignoring Regional Laws

Assuming terms are uniform everywhere. Fix: Our terms follow Italian/EU law. Players in other regions are responsible for complying with their local regulations regarding age, content, and taxes.

Abandoning Your Account

Deleting the game app but not the account. Fix: To fully delete personal data, you must initiate a formal account deletion request via info@trackeno.space. This ensures a clean data handoff.

1.4 Disclaimers & Liability Limitation

Our services are provided "as is" and "as available." We do not guarantee that the services will be uninterrupted, secure, or error-free. You use our games at your own risk.

To the fullest extent permitted by law, Trackeno Studio's total liability to you for any damages arising from your use of our services is limited to the amount you paid us in the six months prior to the claim.
